IPR and Innovation are good for each other - An Open or Shut Case?

This paper considers the relationship between intellectual property rights (IPR) frameworks and open innovation. It has been prepared as a background paper for a discussion session at the European Patent Office (EPO) and DG Enterprise sponsored PATINNOVA Conference, which was held in Prague in April, 2009.

The PATINNOVA conference is the main annual gathering of the EPO. The conference provides an opportunity for experts and stakeholders to reflect upon the role of IPR practice, policy and regulation and to consider the key impacts of the IPR framework upon the processes of innovation and economic development. The 2009 conference focused on the growth of digital industries and the role of IPR frameworks in these sectors’ activities. This paper contributed to the second day of the conference, when policy issues and legal and business practice in relation to IPR were considered. In particular, the implications of IPR for open innovation are considered here.
